Texas House Bill 1649: Fertility Preservation Coverage Services
Applies to:
- Individual/Family plans, including grandfathered and transitional plans
- Student health plans
- Fully insured group plans including grandfathered/transitional plans, small, mid-market, large, PPO, HMO, and POS and Municipalities/Counties/School plans
- Blue Balance FundedSM plans
What you need to know: Texas House Bill 1649 sets new requirements related to fertility preservation.
- Insurers must cover fertility preservation services for people diagnosed with cancer whose treatment may cause infertility.
What’s the impact to plans? Members who are diagnosed with cancer whose treatment may impact their fertility will be covered for fertility preservation services, including but not limited to:
- Sperm cryopreservation
- Cryopreservation of unfertilized oocytes
- Retrieval and procurement of sperm or oocytes
- Preparation for cryopreservation
- Oocyte stimulation/ovarian suppression for fertility preservation
- Sperm or oocyte cryopreservation for children with patient and parent or guardian consent
- Semen analysis
When does this go into effect? The mandate is effective for plans delivered, issued for delivery or renewed on or after Jan. 1, 2024.
